The DeSoto County Courthouse in Arcadia is the smallest courthouse I practice in, and small changes things. Parking is free with no time limit, the building is easy to navigate, and the same Twelfth Circuit rules that govern Sarasota and Manatee apply here on a much quieter docket.
The right building
The DeSoto County Courthouse, 115 East Oak Street, Arcadia, FL 34266. Open 8:30 to 5:00 Monday through Friday, main number (863) 993-4644. The Clerk of Court is in the same building, which is a real convenience compared to Bradenton. It is a redbrick Classical Revival building from the early 1910s and it is a landmark in its own right, but unlike some historic Florida courthouses it is still the working courthouse, not a museum.
Parking, security, and timing
The court’s own words: free parking on the streets and in the lots around the courthouse, with no time limit. There is usually street parking available. This is the one courthouse on this list where I do not think about parking at all before I leave.
Phones are allowed in the building. The Twelfth Circuit’s security order does not list them as prohibited items; what it prohibits is using a phone, laptop, or tablet in a way that disrupts a proceeding, and a judge can direct a deputy to seize a device used that way. Silence it before you go through the courtroom door and you will have no trouble. What does get taken at the door is anything the order calls a non-lethal personal protection device, which means the pepper spray on your keychain. Leave it in the car.
Give yourself thirty minutes more than you think you need. Everyone with a morning docket arrives at the same time, the screening line is longest between 8:15 and 9:00, and walking in late is the one thing that turns a routine morning into a problem.
County court or circuit court
County court handles misdemeanors. Circuit court handles felonies. That single distinction decides which judge you see, which prosecutor is assigned, and how long your case takes. A first DUI, a driving while license suspended, a petit theft, a simple battery: those are misdemeanors, and they are county court cases. A third DUI within ten years, a grand theft, a felony battery: those are circuit court, and they move on a slower and more formal track. If you are not sure which one you have, the charge on your paperwork will say, and I can tell you in a two minute phone call.
DeSoto is part of the Twelfth Circuit along with Sarasota and Manatee, so the same circuit judges, the same administrative orders, and the same diversion program apply. Remote appearance is offered here, and the circuit publishes each judge’s hearing and meeting information on its public court hearings page. Because the volume is low, getting a hearing on calendar tends to be quicker than in Sarasota or Bradenton.
For a first DUI, the Twelfth Circuit diversion program is DETER.
If someone you love is in the county jail
The DeSoto County Sheriff runs the jail and posts a jail roster and a jail FAQ covering visitation, property, and how money gets onto an account. There is no online public records portal in DeSoto, so a request for a report or for body camera video goes to the Sheriff’s office directly. Make that request early: video retention windows are short, and in a small agency there is nobody whose full time job is processing them.
DETER is not the only alternative to a conviction here. It is the first offense DUI program specifically. The Twelfth Circuit also runs a drug court in the circuit, a comprehensive treatment court for lower level non violent misdemeanor and felony cases that takes in mental health, substance use and housing, and other treatment dockets, and the State Attorney separately runs pretrial intervention, which is a different thing with a different gatekeeper. Which door is open depends on the charge, the record, and whether the State agrees. Who sits where, and how to look up your own case
Everything is in the one building, which is the advantage of a small county. The State Attorney is on the third floor at 115 East Oak Street, (863) 993-4881. The Public Defender is in Room 106 of the same building, (863) 993-4891. The Clerk is here too. Note the two phone numbers differ by a single digit.
The Public Defender represents people who qualify financially, and the office is appointed by the court rather than chosen. If you are represented privately you will not deal with them, but it helps to know which building is which.
Your case file is public and you can read it yourself. DeSoto County online court records is the records platform run by the Florida Court Clerks and Comptrollers, which the clerks in smaller counties use instead of hosting their own. Public search needs no login and costs nothing. Looking at your own docket before a hearing is one of the cheapest useful things you can do: it tells you what has actually been filed, what the next setting is, and whether anything was entered that you were not told about.
Who your judge is, and what they want. The Twelfth Circuit publishes every judge in DeSoto, Sarasota and Manatee I do not list judges by name on this page on purpose, because divisions rotate and a name here would go stale. The directory is always current.
Common Questions
Do I have to drive to Arcadia for my hearing?
Often not. Remote appearance is available, and Florida’s rules require a judge to allow it for non-evidentiary pretrial matters set for thirty minutes or less absent good cause. Once you hire a lawyer, a written plea of not guilty also waives your appearance at arraignment in most misdemeanor cases.
Where do I park at the DeSoto County Courthouse?
On the street or in the lots around the courthouse. It is free and there is no time limit.
Is the Clerk’s office in the courthouse?
Yes. Unlike Manatee, where criminal records are in a separate building, the DeSoto Clerk is in the courthouse at 115 East Oak Street.
Can I bring my phone in?
Yes. Silence it before entering a courtroom and do not record without permission. Pepper spray is prohibited.
