A stop leaving a brewery or a restaurant downtown, or along Alternate US-19, can turn into a breath test, a blood draw, or a refusal, and local law enforcement and the Pinellas County Sheriff’s Office patrol the area actively. Dunedin also produces the ordinary range of criminal cases, and we defend each one by testing the stop and the science.

Golf Cart and Low-Speed Vehicle DUIs in Dunedin

Golf carts are part of how Dunedin gets around, from the neighborhoods near the causeway to the streets the city has designated for cart use under its local ordinance. What surprises many folks is that a golf cart is still a vehicle under Florida law, so a DUI on a cart is charged under the same statute, Section 316.193, as a DUI in a car, with the same 0.08 threshold, the same implied-consent rules, and the same penalties. Florida even prohibits an open container in a golf cart on a public street.

A cart case still has defenses a car case does not. Florida only allows golf carts on roads a local government has specifically designated for them, so where the cart was being operated matters. The State has to prove you were driving or in actual physical control, and the legality of the stop is always fair game. There is also a real line between a true golf cart, capped at 20 mph and not registered, and a low-speed vehicle that runs 20 to 25 mph and must be titled and insured, and which one the State is dealing with can shape the case.
