A first DUI arrest in Hillsborough County comes with something most counties cannot offer: a State Attorney program that can end an eligible case as reckless driving with no conviction at all. 1. Every level ends in a withhold, and the withhold is the point
All three RIDR levels end the same way: reckless driving with adjudication withheld and twelve months of probation. No DUI conviction, no mandatory DUI revocation, and a record that can often be sealed later. A DUI conviction can never be sealed in Florida, which is exactly why this reduction is worth working for.
2. The work starts before the plea, and diligence pays
DUI school, treatment, the MADD panel, community service hours, and for Levels 1 and 2 an ignition interlock installed before the plea, not after. The office credits sanctions already completed at sentencing, so the people who attack the checklist early finish faster and cheaper than the people who drift.
3. Two numbers control everything, and both are measurements
A reading of 0.15 separates Level 1 from Level 2, and 0.20 separates eligible from excluded. Those numbers come off an instrument with a calibration history and a margin of error, and before a few thousandths decide your level or your eligibility, the machine’s records deserve a look. That is not a loophole. It is the difference between being measured and being labeled.
